With legislation on the horizon to legalize it, one local store says it's going to just stay put.
The oil is used by a variety of people, and medical testing is being done to determine its efficacy in treating seizures, and pain.
Holcomb asked police in November to hold off confiscating the product from store shelves or issuing tickets. "There is no doubt, as a matter of legal interpretation, that products or substances marketed generally for human consumption or ingestion, and containing cannabidiol, remain unlawful in IN as well as under federal law", Hill said.
As that deadline approaches this month, Holcomb said in a statement Friday that he will extend it to give lawmakers the chance to pass a proposal. "For that reason, I am extending the education period for CBD oil products and the moratorium on issuing citations or removing products from retailers until the legislative session concludes".
Holcomb says he wants to give lawmakers more time to develop legislation that's expected to change the law regarding the sale and use of CBD. This year's session must end by March 14. Cannabis oil could soon be legal for anyone to buy and sell in IN, and Governor Holcomb says he won't stand in the way.
Two of the CBD bills that already passed out of committees would legalize CBD oil as long as it contains less than 0.3 percent THC, the substance responsible for the "high" in marijuana.
Several CBD oil-related bills are now working their way through the Statehouse. A third bill would take the law a step further and allow farmers to grow industrial hemp, the cannabis plant with low THC.
