Stores selling CBD Oil respond to opinion from Kansas AG

Several items in Wichita shops declared illegal according to an opinion on CBD Oil by the Kansas Attorney General.
At least two stores in Wichita sell the by-product of the cannabis plant hemp.
CBD American Shaman on Hillside is open, but did close for the day Monday after someone came in saying they would have to be shut down.
"Couple employees was having a visit by somebody we can't say if it was a Kansas official or not because they did not leave a card, but it did cause quite a scare to my employees with the opinion of the Attorney General it has given quite a scare for people with CBD,” said store owner, Earl Smith.
The Kansas Attorney General said they find cannabidiol, CBD Oil, comes from the parts of the cannabis plant included in the marijuana definition and is thus, illegal.
The shop owners disagree saying their product has health benefits, and is not psychoactive.
"CBD is the part of the industrial hemp plant that has medicinal qualities, we eliminate the part of the hemp plant that has THC that gets you high," said American Shaman on Central manager, Mary Ware.
They list health benefits for those with pain, migraines, diabetes, but the FDA has said that the illegally sold products are not FDA approved in any drug.
"We will stay open until someone comes and physically tells us we have to close because people need this,” said Ware.
The store on Central is part of the same franchise, and say no state officials have come into their store.
The Hillside store is open after deciding to close for just one day.
"What we provide is not illegal, what we have is backed by the Farmer's Act of 2014 because we do provide our CBD from industrial hemp. CBD does come from many different sources, not only does in come from cannabis, it comes from hops as well," said Smith.
The Hemp Industries Association is taking on the Drug Enforcement Administration in the 9th Circuit Court of Appeals in February.

The owner of a Wichita shop that sells CBD -- or cannabidiol oil -- says it will fight an injunction by the state that claims his sales are illegal.
CBD oil comes from industrial hemp, which contains a trace amount of THC.
The owner of the business, CBD American Shaman Wichita, located in the 300 block of N. Hillside, says the state served his shop Monday and said it could be shut down due to the sales.
The State Attorney General's Office issued an opinion last week that states it is unlawful to possess or sell products or substances that contain any amount of cannabidiol or tetrahydrocannabinol.
